When you book a charter or use our Service, you agree to these Terms. Should you not agree with any portion of these terms, then you are not authorized to use the Service.

2. Service Overview

MesaPublicPlaza offers high-end yacht charter services, which include, but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate getaways
  • Exclusive events
  • Extended charters

We provide all services based on availability and prevailing weather conditions. We retain the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

  • Have at least 18 years of age
  • Submit complete and accurate details
  • Provide the necessary deposit as indicated in your booking confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

A booking is only confirmed after payment has been made and we have issued a written confirmation. We may decline service to anyone at our sole discretion.

3.3 Availability

The availability of charters is contingent on vessel availability and favorable weather conditions. We will endeavor to accommodate your requested dates and times as much as possible.

4. Payment Terms

4.1 Pricing

All fees are quoted in € and include all relevant taxes unless stated otherwise. Our prices may change without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the total cost of the charter required at time of booking
  • Balance: To be paid 48 hours prior to departure of the charter
  • Additional costs, if any, must be settled following the completion of the charter

4.3 Payment Methods

We accept common credit cards, electronic bank transfers, and certified cheques for payment. All payments are processed using secure, encrypted techniques.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours before departure: Full reimbursement minus transaction fees
  • 24-72 hours prior to departure: 50% reimbursement
  • Within 24 hours of departure: No reimbursement is provided

5.2 Weather Cancellations

In the case that our captain decides that weather conditions are unsafe, you will be offered the following options:

  • Reschedule the charter to an alternative date at no extra charge
  • Receive a full refund should rescheduling not be viable

5.3 Mechanical Issues

Should mechanical problems occur with the designated vessel, we will attempt to arrange a comparable substitute. If a suitable alternative is not feasible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions given by the crew
  • Use the provided safety gear when needed
  • Disclose any medical conditions that could affect their safety
  • Stay within the designated areas on the yacht

6.2 Prohibited Items

The following are not allowed on board:

  • Glass containers
  • Illegal substances
  • Weapons of any kind
  • Non-alcoholic beverages in excess (beyond reasonable consumption)
  • Animals (unless given prior authorization)

6.3 Conduct

Guests should behave in a courteous and respectful manner. Should passenger behavior pose a safety threat or interrupt the enjoyment of others, we reserve the right to end the charter prematurely with no refund.

7. Liability and Insurance

7.1 Our Liability

Our responsibility is confined to the cost paid for the charter. We are not accountable for:

  • Personal injuries due to guest negligence
  • Theft or damage to personal belongings
  • Indirect or punitive damages
  • Delays occasioned by weather or situations outside of our control

7.2 Insurance Coverage

We carry comprehensive marine insurance that covers our yachts and operations. Passengers are responsible for arranging their own travel and personal insurance coverage.

7.3 Assumption of Risk

By engaging in our yacht services, you recognize that maritime activities bear inherent risks and you accept responsibility for your safety and health.

8. Modifications and Itinerary Changes

We have the right to adjust itineraries, paths, or schedules as necessitated by weather, safety, or operational concerns. We will ensure to offer a similar alternative experience wherever possible.

9. Force Majeure

We are not answerable for interruptions, delays, cancellations, or modifications due to forces outside of our control, including but not limited to:

  • Extreme weather phenomena
  • Natural catastrophes
  • Regulatory impositions
  • Port shutdowns
  • Vehicular malfunctions

10. Privacy and Data Protection

Your data is managed as per our Privacy Policy. You consent to the gathering and utilization of your personal information as detailed in the Privacy Policy by utilizing our services.

11. Intellectual Property

The content on our website, consisting of text, visuals, icons, and photographs, is protected under copyright and trademark regulations. Any reproduction, distribution, or creation of derivatives is prohibited without our express consent.
